CHAPTER 13

FREEDOM OF INFORMATION


13-1-1 COPIES OF CITY DOCUMENTS.
Written Requests of Copies. The following persons are designated as the Illinois Freedom of Information Act (hereinafter referred to as FOIA) persons whom requests for copies of the City’s records should be made.
(A) All requests for copies of records normally kept in the City Clerk’s files shall be made in writing to the City Clerk or, in his absence, the request should be made to the Deputy City Clerk on duty.
(B) All requests for copies of records normally kept in the files of the Water/Sewer Department shall be made in writing to the City Clerk’s office or in his absence to the Superintendent of the Water Department.
(C) All requests for copies of records normally kept in the files of the City’s Police Department shall be made in writing to the daytime dispatcher in the City’s Police Department.
(D) All requests for copies of records normally kept in the files of the library shall be made in writing to the librarian on duty.
(E) All requests for copies of records normally kept in the files of the Park Board shall be made in writing to the president or secretary of the Park Board.


13-1-2 HOURS REQUESTS ACCEPTED. The times during which the City will receive written requests for copies of its records shall be as follows: from Monday through Friday of each week, between the hours of 8:30 A.M. and 4:30 P.M., but not on any legal holidays.


13-1-3 ACTION ON REQUEST. The FOIA person shall, within seven (7) working days after receiving a written request for copies of the City’s records, either deny the request, comply with the request or give notice of his need for an additional seven (7) working days in which to respond to the request in accordance with the Illinois Freedom of Information Act.


13-1-4 APPEALS. All denials of written requests for copies of the City’s records may be appealed to the Mayor by filing a written notice of an appeal of the denial at the Mayor’s office in the Staunton City Hall within fourteen (14) days after the denial. The Mayor shall decide whether to affirm the denial of disclosure or to allow disclosure within seven (7) working days after the notice of appeal is filed.
13-1-5 CHARGE FOR DOCUMENTS.
(A) Schedule of Charges. The City’s initial schedule of charges for making or otherwise providing copies of its records shall be as follows:

(B) Charges for Document Certification. The City Clerk shall certify copies as being true and accurate copies of documents in the City’s records if such certification is requested, and the City Clerk will charge Fifty Cents ($0.50) per complete copy of a document thus certified.
(C) Charges to be Posted. The City Clerk shall post in a public place in the Staunton City Hall a schedule of the City’s charges for making copies of its records and that the City Council may amend that schedule of charges, by resolution, from time to time.
(D) City Codes. The City Codes are available at a cost of One Hundred Dollars ($100.00) per copy.
